By using DownwinderApp (“the app”) you agree to these terms. If you don't agree, please don't use the app.

Safety — please read this part

DownwinderApp is a planning aid, not a safety or navigation device. Forecasts and scores are model estimates that can be wrong or out of date, and real conditions change quickly. Downwind paddling is an inherently dangerous activity, often a committing, one-way trip in wind and water where rescue is difficult.

• Never rely on the app alone. Check actual conditions, official forecasts and marine warnings, tides, and local hazards yourself before going.
• Paddle within your ability, use appropriate equipment and flotation, tell someone your plan, and have a way to call for help.
• You are solely responsible for your decisions on and around the water, and you assume all risks of paddling and related activities.

Nothing in the app is a recommendation that any particular run or time is safe for you.

No warranty

The app and all data in it are provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, reliability, fitness for a particular purpose, or uninterrupted availability. Forecast, marine, river, and map data come from third parties and we do not guarantee it.

Limitation of liability

To the fullest extent permitted by law, DownwinderApp and its creators will not be liable for any injury, loss, or damages of any kind arising from your use of, or inability to use, the app or its data, including decisions made in reliance on it.

Acceptable use

• Don't misuse the app, attempt to disrupt it, or access it through automated scraping or bulk requests.
• Don't resell, redistribute, or build a competing dataset from the app's data or the third-party data it displays.
• Respect the terms of the underlying data providers (Open-Meteo, USGS, LocationIQ, OpenStreetMap).

Your content

Runs you create are yours. If we later add features to save runs to an account or share them publicly, we'll set out the terms for that at the time, and you'll remain responsible for the content you submit.

Third-party data & services

The app relies on and displays data from third parties, each under their own terms. We're not responsible for those services or their content, and their availability can change.

Changes

We may update these terms as the app evolves; the “last updated” date reflects the current version. Continued use after a change means you accept it.

Governing law

These terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules.
